La controversia se generó en torno a las diferentes interpretaciones que hicieron los despachos involucrados del factor territorial.
Como ambos juzgados tienen dicha competencia para decidir la acción de tutela, la Corte considera importante respetar la elección que hizo el accionante.
En consecuencia, dispone enviar el expediente al Juzgado Segundo Civil Municipal de Valledupar, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.
